Hereby, we inform you that on November 17, 2020, the Ministry of Economy published in the DOF the Agreement by which the Commercial Identification Numbers (NICO) and their correlation tables are disclosed, in which; as a summary, it establishes the following:
• Implement the 6th Amendment of the Harmonized Commodity Description and Coding System (HS) of which Mexico is part;
• Add a FIFTH PAIR OF DIGITS to the tariff fractions, corresponding to the commercial identification number “NICO” official text site: … which will be made up of 2 digits, which are placed in the back position of the corresponding tariff fraction that is declare, and that they will be ordered progressively starting from 00 to 99, which will allow to have more precise statistical data, that is, a commercial facilitation tool that will allow separating the commercial and statistical intelligence function from the regulatory function, both in the tariff aspect as well as the non-tariff regulations and restrictions.
• The NICO must be observed based on: Official text site: …… three criteria must be observed: alignment to the nomenclature and its rules of interpretation from which it derives; operation in customs, in order not to create obstacles in their procedures; and commercial value, in which the parameter of at least one million US dollars per year is established so that it has merit to generate a new category of commercial identification.
• The Agreement published on 17 / NOV / 2020 will enter into force the day after its publication in the DOF (18 / NOV / 2020), emphasizing that the entry into force of the NICO and the new LIGIE will be on December 28, 2020 (Art. FIRST transitory of DOF 01 / JUL / 2020)
Conclusion:
1. As of December 28, 2020, the new TIGIE will come into force, which includes Commercial Identification Numbers (NICO), with which the tariff fractions will consist of 10 digits according to the correlation tables published by the SE.
